POLICIES AND TERMS

Our DVDs are written to high quality DVD-Rs that are compatible with most DVD players.  Movie Archive Solutions recommends that you check with your DVD player's manufacturer to ensure that it can play DVD-R videos before ordering, especially if you have an older DVD player.  Movie Archive Solutions will not provide refunds solely due to your DVD player's incompatibility with the media provided.

Movie Archive Solutions respects your privacy.  We will not sell, give, trade or transfer your personal information or your video in any way to any other party, other than as required by law.  We will use your personal information and video only to produce the product(s) you have ordered and for warranty service.

  Movie Archive Solutions Terms of Service

The following describes the terms on which Movie Archive Solutions offers you products and services.  By submitting a videotape or film to Movie Archive Solutions (the "Service"), you ("Customers") accept the terms and conditions below.  Movie Archive Solutions may, at its discretion, add or delete features.  You agree to use the Service consistent with all laws and regulations and in accordance with the terms below.
    
1.     Customer Content
Movie Archive Solutions is not responsible for the content of any of its products, and the views expressed in the Customer content are the responsibility of the Customer and not Movie Archive Solutions.  Movie Archive Solutions reserves the right to refuse to transfer any content using the Service.  Movie Archive Solutions provides the Service but makes no implied or express warranties about the reliability of the Service.  Movie Archive Solutions is not responsible for any damage caused by loss of access to, or deletion or alteration of content. 
The following is a non-exclusive list of actions and content that are not permitted: use of copyrighted material without the express permission of the owner, use of material that is likely to infringe upon the copyright of third parties, material that encroaches the rights of others, including expressions of bigotry, racism, or hatred, material that is perceived by Movie Archive Solutions as abusive, deceptive, profane, slanderous, offensive, or inappropriate, including material that violates any laws or regulations of any governing body with jurisdiction over Movie Archive Solutions, its affiliates and/or users.

It is the policy of Movie Archive Solutions. to report suspected illegal activities to law enforcement agencies and to cooperate fully with their investigations.
     
2.     Copyrighted Material
All material provided by Movie Archive Solutions. including, without limitation, text, software, photos, video, graphics, music and sound, are protected by U.S. and international copyright laws, both as individual works and as a collection.  The use of copyrighted material provided by Movie Archive Solutions or a third-party content provider is allowed by Customers for personal use.  Customers may not copy, reproduce, retransmit, distribute, publish, commercially exploit, or otherwise transfer any such copyrighted material in any format, electronic or otherwise.

3.     Limitation of Liability and Warranty
The media supplied by Movie Archive Solutions is warranted for 30 days from shipment to customers for physical defects.  Use of the service is entirely at the customer's own risk.  The service is provided on an "as is" basis without warranties of any kind, either expressed or implied.  Neither Movie Archive Solutions nor any third-party content or service provider makes any warranty with respect to any content, information, services, or products provided through or in conjunction with the service.

The customer specifically agrees that Movie Archive Solutions or third-party content or service providers are not liable for any conduct by customers associated with the service, including, but not limited to, videotape content.

Movie Archive Solutions and third-party content providers make no guarantee of the accuracy, correctness, or completeness of any information, service or product and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained within the service; or losses or damages arising from the use of the content or services provided by the service.

The customer agrees that Movie Archive Solutions or third-party service providers are not liable for loss of or damage to customer-provided material, even if loss or damage is due to negligence on the part of Movie Archive Solutions or third-party service providers.  This provision notwithstanding, the customer agrees that in the event that Movie Archive Solutions or third-party service providers are ruled to be financially responsible for loss of or damage to customer-provided material, Movie Archive Solutions’s liability will be limited to the replacement cost of equivalent blank media or the cost of the service provided by Movie Archive Solutions, whichever is less.

The customer agrees that Movie Archive Solutions is not liable for loss of or damage to customer-provided material during shipment.  The customer is responsible for requesting and paying all fees associated with insuring the shipment of customer-provided materials.
     
4.     Indemnity by Customer
A Customer agrees to indemnify Movie Archive Solutions and any third-party provider against any and all claims and expenses, including attorneys' fees, arising from the Customer's use of the Service.  This expressly includes claims or any and all liability arising from the violation or infringement of proprietary rights or copyrights.
     
5.     Jury Trial Waiver
THE PARTIES WAIVE THEIR RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY AND ALL DISPUTES ARISING UNDER OR RELATING TO THIS AGREEMENT.
     
6.     Merger Clause
This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between Movie Archive Solutions' representatives and the Customer.  Movie Archive Solutions may amend this Agreement at any time with notice from Movie Archive Solutions to the Customer as published on moviearchivesolutions.com.
